www.VideoCounter.com (hereafter referred to as VideoCounter) and the services provided thereby are released onto the internet by Dr. Robert Biermann with the proviso that you agree to the terms and conditions of use contained herein.
1. Restricted to non-commercial use
The VideoCounter website is intended solely for personal and non-commercial use. This use does not include the right to promote, licence or sell the products, computer programs, information or services included in the internet broadcast, to derive any other commercial use from the latter or to develop derivatives thereof.
2. Exclusion of liability
The products, information, computer programs and services included in this internet broadcast may contain inaccuracies or typographical errors. Dr. Robert Biermann reserves the right to make improvements or changes to VideoCounter at any time. Dr. Robert Biermann bears no responsibility for the appropriateness and reliability of the data and information offered. All data and information are made available as shown without any warranty or guarantee of any kind. Under no circumstances is Dr. Robert Biermann liable for consequential damages, including damages from loss of use, loss of data or damages from loss of profit.
3. No illegal or prohibited use
A condition of your use of VideoCounter is that you assure Dr. Robert Biermann, that you are not using products, information, software, services and associated graphics of VideoCounter for purposes that are illegal or are prohibited by terms and regulations, e.g. copyright etc.
4. Links to websites of third parties
VideoCounter contains links to websites which are provided by information providers other than Dr. Robert Biermann. These links are provided without obligation. Dr. Robert Biermann exercises no control over said websites and is not responsible for their content or any information obtained from said websites and cannot be held liable under any circumstances. If links give cause for complaint we would appreciate being informed of this.
5. Data protection
5.1 Dr. Robert Biermann notes that in accordance with the German Data Protection Act ยง33 personal data shall be stored within the limits of the implementation of the contract.
5.2 Dr. Robert Biermann notes in particular that data protection for the transfer of data in open networks, such as the internet, cannot be guaranteed completely by the current state of technology.
5.3 Data secrecy: Dr. Robert Biermann has made sure that all employees are under obligation to observe data secrecy and shall ensure that the necessary precautions are taken within the company of Dr. Robert Biermann to ensure that the Data Protection Act is adhered to and that customer data is protected as effectively as possible for the users of VideoCounter (hereafter referred to as 'the customer'). In particular, Dr. Robert Biermann shall ensure that data is protected from being accessed by unauthorised persons, including unauthorised employees of Dr. Robert Biermann.
5.4 Communications that the customer forwards to Dr. Robert Biermann (e.g. queries, data, comments) shall not be considered confidential. The customer hereby agrees that Webeffekt shall not be held liable should information relating to the customer be intercepted and used by other persons.
6. Statistics and customer account
In order to document thoroughly the possible viewing numbers of video on video portals Dr. Robert Biermann shall be entitled to publish statistics from customer accounts and name the video title with its link and the video portal, to group the latter and forward them to a third party.
7. Changes to these terms
Dr. Robert Biermann reserves the right to change the terms and conditions by which this internet appearance is provided. Such changes shall come into force two weeks after their publication on VideoCounter.com.
German law applies. The court of jurisdiction is Dinslaken, as long as permissible.
